How State Agencies Can Source a Website Vendor Compliantly

Are you in charge of hiring a website developer for your institution? What are the key considerations in selecting the right web development vendor for public institutions and state agencies? And what are the right procurement practices to keenly follow to ensure value for money?

Public procurement is the process of acquiring goods and services required for government institutions to achieve their objectives. In Ghana, the procurement of a website vendor is not an informal purchasing decision but a regulated procurement activity governed by the Public Procurement Act, 2003 (Act 663), as amended, and supported by the Ghana Electronic Procurement System (GHANEPS).

The Public Procurement Authority (PPA) oversees the harmonisation of procurement processes to ensure the judicious, economic, and efficient use of state resources. Every procurement exercise must be conducted fairly, transparently, sustainably, and with accountability.

The Role of GHANEPS

GHANEPS is a web-based procurement platform that supports the entire public procurement lifecycle, from supplier registration and tender notifications to online evaluation, contract awards, and auction management.

Following a government directive issued on 18 September 2023, the use of GHANEPS became mandatory for all government procurement activities. Suppliers must register on the platform to receive procurement opportunities and participate in tenders.

Sourcing a Website Vendor the Right Way

When procuring website development services, a public institution should begin by clearly defining its requirements. This includes identifying the essential project requirements and distinguishing them from optional features.

The appropriate procurement method must then be selected based on the applicable procurement thresholds. Depending on the circumstances, this may involve Competitive Tendering, Restricted Tendering, or Single-source Procurement.

Before any vendor is considered, the agency should ensure that prospective suppliers meet the required eligibility standards, including valid company registration, tax clearance, and registration on the PPA database.

To maintain fairness, every bidder must receive the same procurement information and documentation throughout the process.

Evaluating Vendors

Vendor evaluation should follow a structured scoring matrix rather than subjective judgement. Proposals should be assessed based on technical quality, experience, methodology, and security to ensure consistent and transparent decision-making.

This approach supports equal treatment of suppliers while helping procurement entities identify the most suitable provider.

Procurement Practices to Avoid

Public institutions should avoid practices that compromise transparency and compliance. These include selecting vendors based solely on informal referrals, changing the project scope after bids have been submitted without formally notifying all bidders, evaluating proposals without a structured scoring system, or inviting suppliers who are unregistered or otherwise ineligible to participate.

Procurement as a Strategic Function

Effective procurement extends beyond purchasing goods and services to contributing value by balancing four key objectives:

  • Cost reduction and control.
  • Quality improvement.
  • Supply Relationship Management (SRM).
  • Risk management.

These objectives help organisations improve efficiency, strengthen supplier relationships, maintain quality standards, and reduce supply chain risks.

So it’s clear that website procurement within Ghana’s public sector should be conducted in accordance with the Public Procurement Act and through the mandatory use of GHANEPS. Define your requirements clearly, select the appropriate procurement method, ensure supplier eligibility, and apply consistent evaluation criteria. As you adhere to established procurement principles, state agencies can procure website services in a compliant, transparent, and accountable manner to achieve value for public resources.
