Terms and conditions

These terms outline the conditions under which EnspireFX Websites (“EnspireFX”, “we”, “us”) accepts, prices, schedules, and executes website design, development, and related digital services. By submitting a project request, approving a proposal, or making any payment, you confirm that you have read, understood, and agreed to these terms in full.

1. Standard Application

These terms apply to all website design, development, hosting, SEO, digital marketing, and related services provided by EnspireFX Websites unless otherwise agreed in writing.

2. Mandatory Project Qualification

All prospective clients must complete EnspireFX’s Get Quote / Project Discovery Form before any engagement.

This requirement applies to:

  • Physical meetings
  • Virtual meetings
  • Phone or video consultations

We do not proceed to consultation, quoting, or proposal stages without a completed form. Information provided is used to assess project scope, budget alignment, readiness, strategic fit, and availability.

3. Right to Accept or Decline Projects

EnspireFX reserves the right to accept or decline any project at its sole discretion.

Projects may be declined due to:

  • Misalignment between scope and budget
  • Unrealistic timelines or expectations
  • Capacity or workload constraints
  • Strategic misfit with our services

Submission of a project request does not guarantee acceptance.

4. Quotes, Pricing & Negotiation

Initial quotes are communicated based on information provided in the discovery form.

  • All quotes are subject to discussion and negotiation
  • Pricing may change if scope or requirements change
  • Verbal, informal, or indicative quotes are non-binding
  • Final pricing is confirmed only in a formal written proposal

5. Proposal Issuance & Validity

A formal project proposal is prepared only when the client confirms readiness to proceed.

  • Proposals are valid for 30 days from the date of issue
  • Projects not commenced within this period must undergo a new review
  • Renewed proposals may include revised pricing, timelines, or scope

Any project that does not take off within one month of the proposal date will be required to restart the process and receive an updated proposal.

6. Invoice Issuance & Payment Terms

Invoices are issued only when the client is ready to make the initial deposit.

Unless otherwise agreed in writing:

  • 50% non-refundable deposit is required before work begins
  • 50% balance is due upon completion, prior to or at launch
  • No project is scheduled or commenced without deposit confirmation

We reserve the right to request full upfront payment for promotional or special offers, without obligation to refund.

Payments are accepted via Bank Transfer or Mobile Money.

7. Pricing Adjustments Due to Economic Conditions

All pricing, including negotiated or previously quoted prices, is subject to change due to prevailing economic and financial conditions.

Factors include but are not limited to:

  • Exchange rate fluctuations
  • Inflation and operational cost changes
  • Hosting, software, and third-party service pricing

For international clients, foreign currency pricing may be adjusted where significant volatility exists.

8. Project Timelines & Scheduling

All timelines provided are estimates, influenced by:

  • Project scope and complexity
  • Client responsiveness and content readiness
  • Current project queue and workload

As a result, two projects of similar scope may have different timelines. For example, a 14-day project may be scheduled as 21 days depending on capacity at commencement.

Final timelines are confirmed in the approved proposal.

9. Prototyping & Design Direction

Where applicable:

  • A one-page “Under Construction” page may be deployed within 72 hours of project acceptance
  • One initial design concept is presented, typically covering the homepage and up to three internal pages

Clients must approve the design structure before full development begins. Major structural changes after approval may incur additional fees and timeline extensions.

10. Client Responsibilities & Content Supply

Clients are responsible for:

  • Providing accurate project information
  • Supplying required content, materials, and approvals on time
  • Responding promptly during review stages

Delays caused by missing content or lack of communication may affect timelines.

Projects inactive for 30 days due to client non-responsiveness may be placed on hold and subject to a re-establishment fee of up to $100 USD (or equivalent).

11. Revisions & Scope Changes

Projects include a reasonable number of revisions as defined in the proposal.

  • Minor revisions are accommodated within scope
  • Major revisions or new functionality outside scope are chargeable
  • Scope changes may affect pricing and timelines

Additional work may require a revised proposal or quotation.

12. Domain Registration

Domains are billed annually and paid in advance.

Clients are responsible for timely renewal. Failure to renew may result in loss of the domain. EnspireFX is not responsible for domain loss due to late or non-payment.

13. Website Hosting

Hosting is billed annually in advance and must be renewed before expiry.

Failure to renew may result in suspension or deletion of files, emails, backups, or data. EnspireFX is not liable for losses arising from delayed payments.

Hosting is provided via third-party providers. While reasonable security measures are taken, EnspireFX is not liable for disruptions caused by factors beyond our control.

14. Ownership, Copyright & Credits

Website ownership and administrative access are transferred only after full payment and project completion.

  • Third-party software, plugins, and licenses remain under their respective owners
  • Custom code not purchased outright remains the intellectual property of EnspireFX

All websites include a footer credit: “Website Design by EnspireFX Websites”

This credit may be removed for a one-time fee of $100 USD (or equivalent).

EnspireFX reserves the right to showcase completed projects in its portfolio and marketing materials.

15. Refund Policy

Web Design & Development

All payments are non-refundable. If a project is cancelled or postponed, payments already made are retained.

Hosting

Hosting may be cancelled within 15 days of setup, subject to a $20 administrative fee. No refunds thereafter.

Other Services

SEO, marketing, and related services are non-refundable once initiated.

Refunds are only considered where EnspireFX is unable to render the agreed service.

16. Search Engine Performance

We do not guarantee specific search engine rankings. Basic SEO best practices are applied unless advanced SEO services are separately contracted.

17. Subcontracting

We reserve the right to subcontract parts of a project where necessary.

18. Confidentiality

Both parties agree to maintain confidentiality of all non-public business information exchanged during the engagement.

19. Governing Law

These terms are governed by the laws of the Republic of Ghana.

20. Disputes, Liability & Indemnity

EnspireFX is not liable for damages arising from misinformation provided by the client.

Clients agree to indemnify EnspireFX against claims, losses, or damages arising from misuse of services, breach of these terms, or third-party claims.

21. Amendments

EnspireFX Websites reserves the right to amend these terms at any time without prior notice.
